Detroit Man Indicted For Marion Murder

The Marion County Grand Jury returned a murder indictment relating to the March 6 shooting death of Trevor Herron. Percy D. Shaw, 23, formerly of Detroit, Michigan, was indicted for two counts of murder with a firearm specification by the Marion county grand jury.

Shaw is alleged to have shot and killed 22 year old Trevor Herron during the early morning hours of March 6. Marion police officers were called to the intersection of West Church Street and Blaine Avenue by neighbors who heard gunshots. Herron was immediately pronounced dead due to a gunshot wound.

Since the shooting, the Police Department and Prosecutor’s Office have been involved in an intensive investigation which involved interviews with dozens of witnesses. Numerous witnesses were subpoenaed to testify at several sessions of the grand jury.

The Marion Police Department previously announced that Shaw was a person of interest in the investigation and sought assistance in locating him. On March 19, Shaw was indicted for a felony charge of having weapons while under disability which alleged that he possessed a firearm on March 6, 2008.

Local authorities enlisted the assistance of the F.B.I. to help locate Shaw. Shaw was arrested in Detroit by the Michigan State Police Fugitive Team on March 21 and served with a warrant resulting from the March 19 indictment.

Shaw has remained in custody in Detroit, Michigan since his arrest while the State has sought a Governor’s Warrant to have him extradited back to Ohio. Thursday, Shaw appeared for court in Detroit, Michigan and elected to waive extradition. Local authorities anticipate bringing Shaw back to Marion within the next few days.

Once Shaw is returned to Marion, he will appear before the Common Pleas Court for an arraignment on the March 19 indictment for Having Weapons While Under Disability, as well as the more recent indictment for Murder. The date and time of this arraignment is not currently scheduled.

If convicted of murder, Shaw faces a mandatory indeterminate prison term of 15 years to life, plus three years for the firearm specification. Marion County Prosecutor Jim Slagle stated that the two counts of Murder both related to the death of Trevor Herron and were charges under different sections of the murder statute.
