As first reported on Friday, an injunction has been filed with the Marion County Court of Common Pleas on behalf of the county in regards to a proposed Marion General Hospital lease.
A hearing for that injunction has been set for June 20th at 9:30 AM before Judge William Finnegan.
The preliminary injunction would prevent Marion City Council from approving the lease without the consent of the Marion County Board of Commissioners.
A special executive session of the council has been called for Tuesday, June 17th to discuss the pending litigation with City Law Director Mark Russell.
The Marion County Commissioners on Thursday voted 3-0 to allow Marion County Prosecutor Jim Slagle to file an injunction keeping Marion City Council from voting on a proposed lease.
The lease with Marion General Hospital received its second reading on Monday, with a third reading and possible vote scheduled for June 23rd.
A vote would break a long standing agreement between the Council and Commissioners concerning governance of Marion General.
City Council voted against postponing the second reading, but could postpone a third. By law, any ordinance must receive three readings unless an emergency is declared.
The commissioners had asked the Council to postpone a vote while a consultant is brought in to review the proposed lease.
That lease would see Marion General’s rent raised to $300,000 with an additional 4% increase per year. It would run through 2043.
