Former Ohio Attorney General Jim Petro will not run for the same spot in November.
Petro told Ohio GOP Chairman Robert T. Bennett he would not seek the post, pointing to the two-term limit which would prevent him from seeking reelection in 2010.
The Ohio Democratic Party has nominated State Treasurer Richard Cordray to run for the post. If Cordray wins, Governor Ted Strickland will appoint a new treasurer.
Petro could still be seeking a Chief Justice run in 2010 when Thomas J. Moyer will be forced into retirement.
