Drug Conviction Upheld 07-01-2008

The Third District Court of Appeals issued a 25 page decision Monday which upheld convictions for trafficking in cocaine and possession of cocaine.

Jerome Douglas, 29, is confined in the Pickaway Correctional Institution serving a 30 month prison sentence imposed following his conviction at a jury trial held last October.

Douglas appealed his conviction to the Third District Court of Appeals claiming that his convictions were against the weight of the evidence and that the court should have granted a mistrial. The Court of Appeals rejected these arguments in the decision.

The trafficking conviction was due to Douglas assisting in the sale of a small amount of cocaine to an undercover operative working under the supervision of the MARMET drug task force. The possession conviction was due to cocaine being found in Douglas’ bedroom, when officers executed a search warrant.

Douglas has remained in custody since his trial. He will remain in prison serving his sentence until February, 2010.
