Percy D. Shaw, 23, has been sentenced to 23 years to life in prison as a result of a murder conviction imposed in late September.
On September 26th a Marion jury returned guilty verdicts for murder with a firearm specification and a charge of possessing weapons while under disability, following a five day jury trial. Shaw appeared before Common Pleas Judge William Finnegan Monday morning for sentencing.
The murder charge carried a mandatory sentence of 15 years to life. Three additional years were required to be imposed for the firearm specification. Finnegan, following Marion County Prosecutor Jim Slagle’s recommendation, imposed an additional five years for the possessing weapons while under disability charge, for a total sentence of 23 years to life in prison. This was the maximum sentence which could be imposed in the case.
Shaw was convicted of murdering Trevor Herron, 22, formerly of Marion, by shooting him during the early morning hours of March 6. The shooting took place outside at the intersection of Blaine Avenue and West Church Street. The weapons under disability charge pertained to Shaw possessing a firearm after having previously being convicted of a drug possession charge.
Shaw was arrested in Detroit, Michigan on March 21, and was returned to Marion on May 5 after Shaw waived extradition. Shaw has remained in custody since his arrest. Later this week, Shaw will be transported to the Correctional Reception Center in Orient to begin serving his prison sentence. The Parole Board will review Shaw’s case in 2031 and will ultimately decide whether Shaw spends the rest of his life in prison.
“This was a difficult case which involved a number of reluctant witnesses. We worked very closely with the Police Dept. to help put this case together,” Slagle stated. “This was a senseless act of violence which can not be tolerated. We think today’s sentence was appropriate.”
